RE: The tariff classification of lamp-holder assemblies from China.

Dear Mr. Montgomery:

In your letter dated February 10, 2011, you requested a tariff classification ruling on behalf of your client, Meico Lamp Parts Co., Inc.

The merchandise under consideration is five styles of lamp-holder assemblies, item numbers 1484, 6427SU, L063, 1495-2, and 1429.

From the information you provided, item number 1484 consists of a porcelain housing containing two standard screw-in Edison sockets, one on either end of the housing, rated for up to 250 Volts (V) and accepting lamps or light bulbs up to 660 Watts (W). Item number 6427SU is comprised of a phenolic housing, at the top end of which is a standard screw-in Edison socket rated for 250 V and 660 W; at the other end is an integrated two-position on-off turn knob snap-action switch. Item number L063 consists of a single screw-in Edison socket rated for 250 V and 250 W contained within a phenolic housing, and features a side-mounted three-position removable turn knob snap-action switch. Item number 1495-2 is made up of a phenolic housing which contains a single screw-in Edison socket rated for 250 W and 250 V, and provides a side-mounted two-position removable turn knob snap-action switch. Item number 1429 is comprised of a phenolic housing containing a screw-in Edison base socket rated for 250 V and 660 W.

The applicable subheading for the lamp-holder assemblies, item numbers 1484, 6427SU, L063, 1495-2, and 1429 will be 8536.61.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for lamp-holders. However, item number 1484 is a lamp-holder assembly with a porcelain housing containing a socket, while item numbers 6427SU, L063, 1495-2, and 1429 are lamp-holder assemblies with plastic housings containing sockets. Accordingly, they are eligible for duty-free treatment in 9902.23.30 HTSUS and 9902.23.29, HTSUS, respectively.

The applicable subheading for item number 1484 will be 9902.23.30, HTSUS, which provides for “Lamp-holder housings of porcelain, containing sockets (provided for in 8536.61.0000).” The general rate of duty will be Free.

The applicable subheading for item numbers 6427SU, L063, 1495-2, and 1429 will be 9902.23.29, HTSUS, which provides for “Lamp-holder housings of plastics, containing sockets (provided for in 8536.61.0000).” The general rate of duty will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
